Tensor Archive Games Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and ExcursionPass Inc., the Delaware corporation that operates Tensor Archive Games (“ExcursionPass,” “Tensor Archive Games,” “we,” “us,” or “our”). These Terms govern your access to and use of tensorarchive.games and its related pages, downloads, licensing, update, verification, network and support services (collectively, the “Services”).

The Tensor Archive Games application and its components are also governed by the Tensor Archive Games End User License Agreement (the “EULA”). If these Terms conflict with the EULA about installation or use of the Software, the EULA controls.

By selecting a “Free Download” button, downloading, installing or using the Software, or otherwise using the Services, you agree to these Terms and the EULA. If you do not agree—including the 100 MiB Network Reserve condition described below—do not download, install or use the Software.

1. Who We Are

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding contract. If you use the Services for an organization, you represent that you have authority to bind that organization. You may not use the Services where applicable law prohibits it.

3. Definitions

  • “Commercial Lifetime” means the period during which ExcursionPass or its successor continues to operate and make Tensor Archive Games commercially available as a product. It does not mean the lifetime of a user, device, company or individual.
  • “Free License” means the no-recurring-fee license granted under the EULA for the features identified as free in the Software.
  • “Network Reserve” means the single shared T2T disk-space budget described in Section 6, capped at 100 MiB (104,857,600 bytes) per operating-system user across participating Tensor Archive products.
  • “Software” means Tensor Archive Games and any application, executable, local service, library, documentation, update or replacement supplied by ExcursionPass.
  • “T2T” means ExcursionPass’s proprietary Tensor-to-Tensor Transport protocol, software, architecture and associated infrastructure.

4. The Services

Tensor Archive Games provides tools designed to create compact local game archives, verify and restore exact game files, maintain eligible archives for official updates, and work with supported game stores and launchers. Available functions depend on the platform, version, supported game, license status, settings, network status and third-party services.

Some functions require an internet connection even though archives are stored locally. Downloads, updates, T2T transfers, entitlement checks, security controls and supported launcher integrations may communicate with Tensor Archive or third-party infrastructure.

5. Free License and “Free Forever”

The Free License is offered without a recurring software-license fee during the Commercial Lifetime of Tensor Archive Games, subject to these Terms and the EULA. “Free forever” means no recurring license fee for that free tier during the Commercial Lifetime; it is not a promise that every feature, platform, online service, network route or third-party integration will remain available forever.

Features, supported games, integrations, interfaces and operational requirements may evolve as the product develops. A future separately priced plan or service does not convert the Free License into a subscription or remove the local rights already granted for a valid free version, subject to its technical dependencies and these Terms.

6. T2T Network Reserve — Required Free-License Condition

Authorization for the Network Reserve is a material, non-severable condition of the Free License. By selecting a Free Download button, downloading, installing or using the Software, you authorize Tensor Archive to manage a single shared Network Reserve of no more than 100 MiB (104,857,600 bytes) per operating-system user across Tensor Archive AI, Tensor Archive Games and other participating Tensor Archive products. It is one total cap, not 100 MiB per application.

The Network Reserve exists for Tensor Archive network utility and product operation. It may temporarily retain eligible, verified T2T pieces where there is authorized demand, including pieces used to route, verify, cache, stage or serve supported content. The reserve is not preallocated as an empty 100 MiB file and does not consume the full amount merely because the Software is installed. Space is used only when eligible verified pieces are admitted, and use must remain within the shared cap.

Of the 100 MiB physical ceiling, the current design permits up to 96 MiB of payload and keeps the remainder for database, index, journal and filesystem overhead. The Software may empty or reclaim the reserve under product controls, expiry, revocation or disk pressure before touching a user’s protected archives. The Network Reserve does not authorize access to unrelated personal files, private game-library lists, credentials or unapproved content.

If you do not authorize this Network Reserve, you are not eligible for the Free License and must not download, install or use the Software under that license.

7. T2T Network and Always Updated

Depending on your version, supported content and enabled settings, the Software may locate authorized sources, retrieve verified data, cache or stage eligible pieces, and make eligible verified pieces available as an authorized T2T source. T2T access does not grant you any right to reproduce, emulate, reverse engineer, resell, host or otherwise exploit the protocol or infrastructure.

Always Updated is a separate product setting. When enabled, an active client may receive an official game update, identify and verify changed bytes, and make eligible changed bytes available so compatible archives can advance without retransferring the whole game. The applicable game store or launcher remains the entitlement and update authority.

We may change source selection, security, authentication, contribution, caching, supported-content and abuse-prevention rules. We do not guarantee any source, route, transfer speed, update, availability or service level.

8. Game Content, Stores and Entitlements

You retain your rights in content you own, and third-party game content remains owned by its publishers and licensors. Tensor Archive Games does not sell games or grant rights to third-party content. You are responsible for maintaining valid entitlements and complying with the terms of each game, mod, store, launcher and platform you use.

Tensor Archive Games does not bypass or authorize bypassing DRM, anti-cheat, store entitlement, launcher verification or publisher restrictions. Steam and every other supported service remain responsible for their own accounts, purchases, entitlements, official updates and execution. References to a platform or game do not imply affiliation or endorsement.

9. Your Responsibilities

You are responsible for having all rights and permissions required to store, process, restore or transfer content; protecting credentials and confidential information; verifying restored output before relying on it; and maintaining independent backups appropriate to the value and risk of your content.

Do not use Tensor Archive Games as the only copy of valuable data. No storage, reconstruction or transfer system eliminates the need for independent backups and testing.

10. Acceptable Use

You must not, and must not enable anyone else to:

  • use the Services unlawfully or infringe another person’s rights;
  • transfer malware, corrupted content, stolen credentials or content you are not authorized to distribute;
  • interfere with, overload, degrade or evade controls of the Services, T2T or another user’s systems;
  • access non-public systems, data, APIs, sources or administrative functions without authorization;
  • forge or manipulate licenses, entitlements, device identities, signatures, manifests, receipts, transfer records or authorization messages;
  • circumvent DRM, anti-cheat, launcher entitlement, update, security, network or access restrictions; or
  • use an unauthorized client, bot, emulator or modified binary to access the Services or T2T.

11. Intellectual Property

The Services, Software, T2T, website, designs, documentation, source and object code, algorithms, architecture, non-public interfaces, protocols, trademarks and related materials are owned by ExcursionPass or its licensors and protected by applicable laws. Except for the limited rights expressly granted in these Terms and the EULA, no right or license is granted.

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate them without restriction or compensation. This does not grant us ownership of your games, mods, archives or other content.

12. Privacy

Our processing of personal information is described in the Tensor Archive Games Privacy Notice. Third-party stores, launchers and infrastructure providers process information under their own terms and privacy notices.

13. Pre-Release Software, Backups and Product Claims

Some or all of Tensor Archive Games may be alpha, beta, preview, evaluation, experimental or pre-release software. It may be incomplete, change without notice, contain errors, lose compatibility or be withdrawn.

Storage, restoration and performance results depend on the game, build, installed content, platform, hardware, filesystem, configuration and successful verification. Research measurements and marketing examples do not guarantee your result.

14. Suspension and Termination

We may suspend or restrict online Services, T2T, updates, sources, destinations or content where reasonably necessary to investigate or prevent fraud, piracy, abuse, infringement, security threats or technical harm; enforce content-rights and license requirements; comply with law; or protect Tensor Archive, users, infrastructure or third parties.

We may terminate these Terms for material breach. Upon termination, rights granted under these Terms end. Provisions that by their nature should survive will survive, including ownership, restrictions, disclaimers, liability limits and dispute terms.

15. Third-Party Services

The Services may link to, interoperate with or depend on third-party services. We do not control those services and are not responsible for their terms, content, security, availability, changes or acts. Your relationship with a third party is governed by your agreement with that third party.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, SOFTWARE, T2T, CONTENT, PRE-RELEASE FEATURES AND DOCUMENTATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. EXCURSIONPASS DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY AND OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND SECURITY.

WE DO NOT WARRANT THAT TENSOR ARCHIVE GAMES WILL BE ERROR-FREE, UNINTERRUPTED, COMPATIBLE WITH FUTURE HARDWARE OR SOFTWARE, IMMUNE FROM DATA LOSS OR SECURITY INCIDENTS, OR THAT ANY ARCHIVE, RESTORE, GAME, UPDATE, SOURCE, TRANSFER, SPEED OR STORAGE RESULT WILL MEET YOUR REQUIREMENTS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCURSIONPASS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES; LOSS OR CORRUPTION OF DATA; LOSS OF GAMES, MODS, ARCHIVES, PROFITS, REVENUE, SAVINGS, BUSINESS, GOODWILL OR USE; COST OF SUBSTITUTE SERVICES; OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR AGGREGATE LIABILITY ARISING OUT OF THE SERVICES, SOFTWARE, T2T OR THESE TERMS WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID EXCURSIONPASS FOR THE SPECIFIC TENSOR ARCHIVE GAMES SERVICE GIVING RISE TO THE CLAIM. Rights and liability that applicable law does not permit us to exclude remain unaffected.

18. Governing Law, Changes and General Terms

These Terms and disputes arising from them are governed by Delaware law, without regard to conflict-of-laws rules. Before filing a claim, each party will provide a written description and allow 30 days for a good-faith attempt to resolve it. Except where applicable law requires otherwise, the state courts in New Castle County, Delaware, and the United States District Court for the District of Delaware have exclusive jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES TRIAL BY JURY AND AGREES TO BRING CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE OR REPRESENTATIVE ACTION.

We may update these Terms prospectively for later downloads, releases or online functionality. The posted version and effective date identify the applicable terms. Continued use of evolving online Services after updated Terms take effect constitutes acceptance; if you do not accept them, you must stop using the affected Services.

These Terms, the EULA and the Privacy Notice constitute the entire agreement about their subject matter. If a provision is unenforceable, the remainder remains effective. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of the Tensor Archive business.
